Practices that may help primary care providers reduce their risk of being sued include routinely <a href=\"https:\/\/www.rmf.harvard.edu\/Clinician-Resources\/Newsletter-and-Publication\/2016\/SPS-November-Pass-the-History?sc_camp=0EB2AF4DEE834EB995C210A024A5DB29\">updating family histories,<\/a>recognizing cancer risks for <a href=\"https:\/\/www.medpagetoday.com\/meetingcoverage\/ddw\/73244\">younger<\/a> patients with certain histories and symptoms,<sup>1<\/sup> and coordinating care with other providers who share a patient\u2019s diagnostic process.<\/p><p>The four most commonly diagnosed cancers for U.S. adults<sup>2<\/sup> are:<\/p><ul><li><strong>Breast<\/strong> (269,000 annual diagnoses)<\/li><li><strong>Lung<\/strong> (234,000)<\/li><li><strong>Prostate<\/strong> (165,000)<\/li><li><strong>Colon and Rectal<\/strong> (140,000)<\/li><\/ul><p>Given the impact of such diagnoses on quality of life and life expectancy, it is no surprise that a <em>failure<\/em> to diagnose one of those cancers is among the most common allegations in medical professional liability (malpractice) claims and lawsuits. Analysis of more than 95,000 cases reported to CRICO\u2019s national <a href=\"https:\/\/www.rmf.harvard.edu\/Products-and-Services\/CRICO-Strategies-Products-and-Services\/CBS?sc_camp=0EB2AF4DEE834EB995C210A024A5DB29\">Comparative Benchmarking System<\/a> (CBS) found 1,684 cases filed from 2007\u20132016 with an allegation of a missed diagnosis of one of those four cancer types. Incidents that evolve into medical malpractice cases do, generally, represent a subset of similar adverse events. Clinicians who see patients in the key demographic segments most susceptible to these common cancers are at risk for a missed or delayed diagnosis, even if they have never been named in a malpractice case.<\/p><p>While <a href=\"https:\/\/www.cancer.gov\/about-cancer\/screening\/screening-tests\">routine screening<\/a> can be a valuable tool for cancer detection, it is not infallible. Many cancers are undetected in their early stages despite diligent compliance with recommended screening regimens. The CBS case details indicate that allegations of malpractice related to missed cancers are often triggered by breakdowns in the broader diagnostic process. Not every missed diagnosis is the result of clinician error but, too often, these cases reveal missed opportunities.
